These Terms and Conditions govern sales contracts concluded through shopsmartbay.com between NOVAFRONTIER SYSTEMS S.L. (the Seller) and its customers. By submitting an order, the customer agrees to these Terms.

2. Products and prices

Product descriptions, prices, taxes and any applicable charges are displayed during the ordering process. The price applicable to an order is the price shown when that order is submitted, subject to correction of obvious errors and any rights provided by applicable law.

3. Order process

The customer places an order by completing the checkout process and providing the requested information. An order is accepted when the customer receives confirmation from the Seller. The Seller may contact the customer when information is required to process the order.

4. Payment

Available payment methods and any related conditions are displayed during checkout. The customer must provide accurate payment information and ensure that they are authorized to use the selected payment method.

5. Delivery

Available destinations, estimated delivery times and shipping charges are shown during checkout or described in the Shipping Policy. Delivery estimates may be affected by circumstances outside the Seller’s reasonable control.

6. Cancellations, returns and refunds

7. Product conformity

Products are covered by the mandatory statutory rights and conformity guarantees applicable to the customer. Nothing in these Terms limits rights that cannot lawfully be excluded.

8. Acceptable use

Customers must not misuse the website, attempt unauthorized access, interfere with its operation or use it for unlawful or fraudulent purposes.

9. Limitation of liability

To the extent permitted by law, the Seller is not responsible for loss resulting from misuse of a product, unauthorized modification or failure to follow product instructions. Nothing in these Terms excludes or limits liability where doing so would be unlawful.

10. Governing law and disputes

These Terms are governed by the laws applicable to the Seller, without depriving consumers of mandatory protections available under the law of their habitual residence. Consumers may bring disputes before any court or dispute-resolution body competent under applicable law.

11. Changes to these Terms

NOVAFRONTIER SYSTEMS S.L. may update these Terms when necessary. The version applicable to a purchase is the version made available when the order is submitted.
